Facts
Federal prisoner Jeremy Brown (defendant) was assaulted by a prison guard. The guard was prosecuted and entered a guilty plea. Brown then filed a civil suit related to the assault. Prison personnel were aware of the suit and knew Brown because he wrote an inordinate number of grievances against prison staff. Brown was then indicted for assaulting a guard by throwing feces and urine in the guard’s face. Brown moved to dismiss the indictment, arguing that the indictment was the result of selective or vindictive prosecution
