Facts
Merlin Bruguier (defendant) was charged with aggravated sexual abuse of his infant daughter. At trial, two witnesses testified that Bruguier was a good father. One of the witnesses said that Bruguier had never abused his children. On cross-examination, the prosecution (plaintiff) asked the witnesses if they were aware that the Department of Social Service (DSS) had previously found Bruguier neglectful of his children. The witnesses were not aware of this. The trial court admitted the line of questioning over Bruguier’s objection. Bruguier was convicted, and he appealed.
