United States v. Castro-Ayon

United States Court of Appeals for the Ninth Circuit
537 F.2d 1055 (9th Cir. 1976)

Rafael Castro-Ayon (defendant), a United States citizen, was pulled over in his van carrying 11 illegal immigrants. The immigrants were taken into custody and were interrogated about Castro-Ayon under oath. Castro-Ayon was charged with inducing illegal immigration, transporting illegal immigrants, and conspiracy. At trial, three of the immigrants testified that Castro-Ayon was not at fault. The prosecution then called Agent Pearce, the interrogating agent, who testified that the immigrants’ prior statements during interrogation were inconsistent with their testimony. The trial court admitted the testimony and instructed the jury to consider the immigrants’ prior statements for impeachment purposes and as evidence of Castro-Ayon’s guilt. Castro-Ayon was convicted. He appealed.
