Facts
Frank Cathey (defendant) was convicted of tax evasion. During his trial, the prosecution cross-examined Cathey about his prior military conviction for larceny. Also during his cross-examination, the prosecution caught Cathey in many misstatements and contradictions. At the time of the trial, Cathey’s larceny conviction was more than 16 years old. Following his conviction, Cathey appealed the admission of evidence of his prior larceny conviction.
