Facts
Cooper (defendant) published a paper broadly criticizing President Adams for a variety of policy decisions and actions. The paper criticized Adams for forming a permanent navy, being on the verge of having a standing army, and degrading the country’s credit during a time of peace. Further, the paper suggested that Adams improperly interfered with judicial proceedings to an extent that the British king would not. Finally, the paper criticized Adams for sending an American citizen for trial in Great Britain. The United States (plaintiff) charged Cooper with violating the Sedition Act of 1798.
