Facts
Cowan (defendant) was one of two individuals indicted by a federal grand jury in Texas on charges of fraudulent misuse of savings and loan funds. Cowan’s co-defendant, Jacobsen, was indicted by a second grand jury in the District of Columbia on charges related to involvement in the Watergate scandal. Jacobsen negotiated a plea agreement in which the United States agreed to forego prosecution of the charges related to the Watergate scandal and to dismiss the Texas indictment in exchange for Jacobsen’s testimony against other defendants. The Texas district court refused to dismiss the indictment against Jacobsen. The United States District Attorney filed notice of his intention not to prosecute Jacobsen. The district court appointed special prosecutors to proceed against Jacobsen. The United States appealed the order appointing special prosecutors.
