Facts
On April 30, 1995, the Bank One in Chandler, Arizona was robbed. Thomas Riley, who admitted robbing the bank, claimed that David Crumby (defendant) also participated as an “inside man” in the robbery. Crumby maintained his innocence. Crumby submitted to a polygraph test. A former polygrapher for the Phoenix police department administered the test. The polygrapher evaluated the results and determined that Crumby was truthful in stating that he did not participate in the robbery. Crumby moved the court for an evidentiary hearing concerning the admissibility of the polygraph evidence.
