Facts
At the trial of Kyle DeCoteau (defendant), the prosecution (plaintiff) called S.S. and R.S. to testify. S.S. and R.S. were nine and 13 years old at the time of their testimony. They also had learning disabilities. DeCoteau was convicted. DeCoteau filed a motion for a finding of ineffective assistance of counsel on the ground that his defense attorney did not challenge the competency of S.S. and R.S. to testify.
