Facts
Dee (defendant) was employed by the United States Army in a civil role. Dee was involved in developing chemical-warfare systems. The United States (plaintiff) charged Dee and other defendants with violating the Resource Conservation and Recovery Act (RCRA) by illegally storing, treating, and disposing of hazardous wastes. Dee and the other defendants asserted that they were immune from the criminal provisions of RCRA due to their status as federal employees working at a federal facility.
