Facts
Diaz (defendant) was charged with conspiracy to distribute heroin. At trial, the prosecution (plaintiff) introduced inculpatory recordings of Diaz and of others talking about Diaz. The prosecution then called U.S. Drug Enforcement Agency task force officer Gula to testify about what the conversations meant. Gula gave his interpretation of the meaning of many of the recorded conversations. For example, on one recording, Diaz stated, “[y]o you know this bags are different sizes right?” Gula testified that Diaz was talking about bags holding drugs. Gula also testified that he believed that Diaz had participated in the conspiracy. Diaz was convicted, and he appealed, arguing that Gula’s testimony should not have been admitted.
