United States v. DiPaolo
United States Court of Appeals for the Second Circuit
804 F.2d 225 (1986)
- Written by Serena Lipski, JD
Facts
Nick DiPaolo, Edward Weather, and Paul Snyder (defendants) were convicted of crimes relating to a Postal Service robbery and intimidation and use of physical force against Lucille Barone and Joanne Barone. During their cross-examination of Joanne Barone, the defendants sought to cross-examine Joanne Barone about her drinking problem. The trial court held an in-camera hearing in which Joanne testified that, although she did have a drinking problem at points during her life, she was not drinking at the time she was assaulted and had been sober for at least a few weeks. Based on the in-camera hearing, the trial court did not permit the defendants to cross-examine Joanne about her drinking problem. Following their conviction, DiPaolo, Weather, and Snyder appealed.
