Facts
Kemepaudor Ekiyor (defendant) was flying from Nigeria to Canada with connecting flights in Amsterdam and Detroit. At the Detroit airport, law-enforcement officers found six kilograms of cocaine in a locked suitcase. Ekiyor’s name was on the suitcase’s luggage tag, and Ekiyor had a key that opened the suitcase. Ekiyor was charged with importing cocaine and possession with intent to distribute cocaine. Before trial, Ekiyor moved to compel the United States (plaintiff) to disclose information about drug trafficking by airport baggage handlers. The government told the court that it had given Ekiyor information regarding two recent cases in which baggage handlers had been charged with drug smuggling, but the government refused to provide Ekiyor with any further information.
