Facts
Cross-appeals resulted from a prosecution for selling protected wildlife in violation of the Migratory Bird Treaty Act, 16 U.S.C. §§ 703, 707(b)(2) (MBTA). Engler (defendant) was convicted under the MBTA due to allegations that he sold protected birds in violation of the MBTA. Engler appealed the trial court’s conviction, asserting, among other issues, that the United States (government) (plaintiff) entrapped him as a matter of law.
