Facts
Kerry Enjady (defendant) was charged with raping A. Enjady claimed that the sex with A was consensual. The prosecution (plaintiff) sought to introduce the testimony of B that Enjady had raped B two years prior. The district court considered the evidence under Federal Rule of Evidence 403 (Rule 403) and allowed it. Enjady appealed.
