Facts
Fallon (defendant) was convicted of federal crimes related to the alteration of odometer readings on used cars. Huebner was charged as a co-conspirator. Huebner entered into an agreement with the prosecution under which the government agreed to pursue limited charges and recommend no prison sentence as long as Huebner satisfactorily cooperated in the prosecution of Fallon. During trial, Fallon moved to strike Huebner’s testimony. The district court granted the motion and instructed the jury to disregard Huebner’s testimony. The United States (plaintiff) appealed the trial court’s decision to strike Huebner’s testimony.
