United States v. Feola
United States District Court for the Southern District of New York
651 F. Supp. 1068 (1987)
- Written by Arlyn Katen, JD
Facts
Gary Feola and eighteen other people (defendants) were charged with operating a cocaine and marijuana trafficking ring. The defendants filed several discovery motions in federal district court. One discovery request encompassed the government’s (plaintiff) entire investigative file, but most requests were more specific. Examples of specific requests included evidence of promises of preferential treatment and any impeachment information regarding government witnesses, recordings and notes of interviews or communications that law-enforcement personnel made in relation to the case, all government witnesses’ names and addresses, all defendants’ statements and criminal records, and results of scientific tests and polygraph examination results.
