Facts
Fernandez (defendant) was a businessman who provided a Puerto Rico legislator with a trip to Las Vegas to see a boxing match in exchange for favorable action on legislation. Fernandez was charged with violations of 18 U.S.C. § 666, a federal statute that criminalizes bribery and corruption of government officials connected to federal funds. The jury instructions permitted a conviction under § 666 based on a gratuity theory. Fernandez was convicted and appealed.
