Facts
In a grand-jury investigation into suspected antitrust violations, First National City Bank (Citibank) (defendant) was served with a subpoena to produce all its documents in its Frankfurt, Germany, office about certain customers. Citibank refused and argued that if it complied with the subpoena and produced the documents, that would subject it to civil liability to those customers under German law. The district court found Citibank liable for contempt, and Citibank appealed.
