Facts
On December 29, 2008, a woman (defendant) carrying a United States passport for Sandra Calzada, a Puerto Rican woman with an outstanding arrest warrant, arrived in the United States on a flight from the Dominican Republic. The woman was taken to a secondary inspection area and was questioned about her identity by Customs and Border Protection Officer Frank Umowski. The woman was not given Miranda warnings before being questioned. Umowski determined that the woman was not Sandra Calzada because the woman’s fingerprints did not match Calzada’s and because the woman could not answer questions about Puerto Rico or about Calzada’s background. The woman was arrested and charged with making false statements in connection with a passport application, the misuse of a passport, and identity theft. The woman moved to suppress the statements she made to Umowski, arguing that she was improperly not given Miranda warnings before she was questioned.
