Facts
Franck’s Lab, Inc. (defendant) was a compounding pharmacy that mixed bulk ingredients to make drugs for animals. After 21 polo horses were accidentally killed by a mistake at Franck’s, the Food and Drug Administration (FDA) sued to enjoin Franck’s from compounding drugs. The FDA took the position that any compounding of animal medications from bulk substances for non-food-producing animals violated the Food, Drug, and Cosmetic Act.
