Facts
Adam Frost (defendant) was charged with raping AW, a 17-year-old girl. Immediately after the rape occurred, AW used her cell phone to call her sister, Bridget. AW told Bridget that AW had been raped by Frost. AW was crying on the phone. At the trial, the government (plaintiff) introduced AW’s statement to Bridget. The statement was offered to prove that Frost raped AW. The district court admitted AW’s out-of-court statement. Subsequently, Frost was convicted. Frost appealed.
