Facts
Fabio Gasperini (defendant) was charged with various crimes related to computer fraud. The government (plaintiff) alleged that Gasperini used a botnet to hack into third-party computers to artificially increase the number of times certain advertisements were viewed. The government sought to introduce various business records of Linode, LLC, which it claimed provided servers to Gasperini. Gasperini filed a motion to exclude the business records on the ground that they lacked trustworthiness because Linode had been hacked multiple times.
