Facts
The United States government prosecuted James H. Giffen (defendant) in federal district court on mail-fraud, wire-fraud, and other charges relating to $78 million in bribes that Giffen allegedly paid to senior officials in the government of Kazakhstan. Many of the charges accused Giffen of illegally depriving Kazakh citizens of their intangible right to the honest and loyal services of their leaders. Giffen moved to dismiss the honest-services charges.
