Facts
Roy Valentine Gilliland (defendant) was charged with transporting a stolen car across state lines. At trial, he called Billy Tull, his stepson, as a witness. Tull testified that he witnessed Gilliland purchase the car. On cross examination, the prosecution asked Tull if Gilliland was “the kind of man” who would steal cars. After Tull said “no,” the prosecution introduced evidence, over Gilliland’s objection, about past times that Gilliland was convicted of stealing cars. The court convicted Gilliland. He appealed.
