Facts
Goldberg (defendant) was charged with federal fraud and tax offenses. His coconspirators, Lango and Clark, made certain statements in furtherance of the federal conspiracy—a fact that Goldberg does not contest—but the statements were made before Goldberg actually joined the conspiracy. The prosecution sought to enter the statements into evidence. The trial court admitted the statements as admissions by a party opponent and convicted Goldberg. Goldberg appealed.
