Facts
Salvador De Jesus Gutierrez-Castro (defendant) was charged with a crime. The United States (plaintiff) offered James McNutt as an expert witness. McNutt worked for the Border Patrol/Forensic Document Laboratory. McNutt planned to testify about fingerprint analysis and that several fingerprints in evidence belonged to Gutierrez-Castro. Gutierrez-Castro objected to McNutt’s classification as an expert witness while acknowledging that McNutt could not be excluded as a witness altogether.
