Facts
MB told her mother and grandmother that Henderson (defendant) touched her “front-bottom,” a term MB used for her vaginal area. MB was four years old at the time. MB had uncharacteristically refused to sit down in the tub the night before and generally had been acting withdrawn and shy. Henderson was charged. At trial, the prosecution (plaintiff) sought to introduce MB’s out-of-court statements to her mother and grandmother. The trial court admitted the statements over Henderson’s objection under Military Rule of Evidence 807. MB testified at trial but was not able to answer all questions posed to her. Henderson was convicted, and he appealed.
