Facts
Ho (defendant) was the security manager for the Maui airport security company. Ho argued with an employee, had officers whom he supervised arrest the employee, ordered the other meeting attendees to leave, and struck an employee who refused. Ho told a witness to tell the Maui police that she was about to go home when the incident occurred and did not see what happened because her view was blocked. The witness repeated this false version to the Maui police. Ho also instructed the witness to prepare a written statement for their employer summarizing the false version. Ho was charged with witness tampering in violation of 18 U.S.C. §§ 1512(b)(1) and 1512(b)(3) for interfering with investigations by the Maui police and Ho’s employer. Ho moved for in camera review of any portion of the grand jury minutes that showed the government (plaintiff) misinstructed the grand jury.
