Facts
Billy Herd, John Houlihan, and others (defendants) were charged with the murder of James Boyden. At trial, the prosecution sought to introduce Boyden’s statement to his sister as he was leaving her apartment on the night he was killed. Specifically, Boyden had told his sister that he was going to meet Herd. The defendants objected to the admission of the statement, seeking to exclude the statement as hearsay.
