Facts
Mykola Ihnatenko and Mykhailo Yurchenko (defendants) were indicted for conspiracy to commit a drug offense aboard a United States vessel. Rene Franco-Zapata agreed to cooperate with the government and testify against Ihnatenko and Mykhailo. In exchange for his agreement to testify, the government gave cash payments to Franco-Zapata’s housing providers and to Franco-Zapata and his family, promised not to prosecute Franco-Zapata or his daughter for drug offenses, and provided resident-alien cards that allowed Franco-Zapata and his family to live and work in the United States. Ihnatenko and Mykhailo were convicted and argued on appeal that the compensation the government gave to Franco-Zapata in exchange for his testimony violated § 201(c)(2) of the federal bribery statute.
