United States v. Jefferson
United States Court of Appeals for the Fifth Circuit
623 F.3d 227 (2010)
- Written by Serena Lipski, JD
Facts
Mose Jefferson (defendant) was indicted for crimes involving the Racketeer Influenced and Corrupt Organizations Act. The prosecution moved to admit evidence of Jefferson’s prior convictions for bribery and obstruction of justice to impeach him as a witness. Two counts in the indictment for Jefferson’s prior conviction for obstruction of justice stated that Jefferson knowingly and corruptly attempted to persuade another person to lie to federal law-enforcement authorities. The court excluded the evidence, and the prosecution filed an interlocutory appeal.
