Facts
Alan Johnson (defendant) was charged with abusive sexual contact on an aircraft. The prosecution (plaintiff) alleged that Johnson touched a flight attendant inappropriately, grabbed a second flight attendant inappropriately, and thrust his crotch against a fellow passenger. The prosecution sought to admit evidence of prior occasions on which Johnson had allegedly made inappropriate contact with a female. Specifically, the prosecution had evidence that Johnson had thrust his crotch against a female employee at a retail store and that Johnson had groped a female employee at a second retail store. The district court admitted this evidence. Johnson appealed.
