Facts
Three major stockholders (defendants) in the Thunderbird Valley Corporation were charged with mail fraud. At the trial, the government (plaintiff) sought to prove that the stockholders participated in an elaborate land-sale fraud involving Thunderbird Valley. A summary of Thunderbird Valley’s records had been prepared by Mr. Harbert, a postal inspector. The records contained hearsay. The government introduced Harbert’s summary, and the district-court judge admitted the summary. Subsequently, the jury convicted the stockholders. The stockholders appealed.
