Facts
Wesley Jones (defendant) was a mid-level dealer of crack cocaine and a member of a ring of drug dealers based out of a housing project in New York. Jones sold crack cocaine to undercover officers from the Bureau of Alcohol, Tobacco, and Firearms who were investigating the drug ring. Jones was arrested. At the time, Jones was 31 and had 14 prior criminal convictions, all from his late teens and early twenties, including two relating to drug charges. Jones had committed those crimes after having been turned out of the home he shared with a foster parent and nine other children. By the age of 31, Jones was in a stable relationship and was an active parent to his 11-year-old son. Jones cooperated with the prosecution and pled guilty to conspiring to distribute and possess with intent to distribute narcotics, and the United States (plaintiff) presented his case to the court for sentencing.
