Facts
Arlan and Linda Kaufman (the Kaufmans) (defendants) were indicted for Medicare fraud, civil-rights violations, subjecting victims to involuntary servitude, and other crimes. The allegations included sexual misconduct involving mentally ill patients. In support of motions to quash subpoenas addressed to certain victims, mental-health professionals opined that the victims would be unable to withstand the stress of testifying in court. Two of the victims testified and were visibly distressed trying to formulate answers. Media General Operations, Inc. (Channel 12) moved to intervene and permit sketch artists in the courtroom. None of the parties wanted a sketch artist in the courtroom, and no juror wanted his likeness to be drawn and displayed on television. Channel 12 stipulated that its sketch artists would not sketch victims or jurors.
