Facts
Officer Aubrie Thompson was called to an apartment complex after a report that a man with a gun was causing a disturbance. Upon investigating, Thompson found Jerrel Montel King (defendant) with a pistol next to his foot. King was accompanied by the mother of his child, Leginia Washington. A search of Washington’s nearby car revealed two large bricks of marijuana and a rifle with an extended magazine, all locked together in the trunk. King admitted to officers that the contraband and rifle belonged to him. Officers also found a photograph of the rifle stored in King’s cellular phone. King was convicted of possessing marijuana with the intent to distribute and possessing a firearm in furtherance of a drug-trafficking crime. King appealed his conviction for possession in furtherance of a drug-trafficking crime.
