Facts
Kolby Kristiansen (defendant) was charged with escaping from a halfway house. His defense was that he was a cocaine addict and suffering from psychosis and so could not form the willful intent to escape. Kristiansen’s expert witness, Dr. Knowles, testified that Kristiansen was on cocaine at the time of the escape and was allowed to testify that psychosis could cause people not to appreciate the wrongfulness of their actions. However, the trial court did not permit Dr. Knowles to testify that psychosis would affect a person’s ability to appreciate his actions. The trial court convicted Kristiansen and he appealed.
