Facts
Federal authorities arrested Charles Larsen (defendant) for his role in smuggling marijuana aboard a vessel seized in international waters. A district-court jury found Larsen guilty of violating 21 U.S.C. § 841(a)(1), which prohibited the possession or distribution of illegal narcotics. The statute did not explicitly provide for its extraterritorial applicability. Larsen appealed his conviction to the Ninth Circuit.
