United States v. Lee
United States Court of Appeals for the Eleventh Circuit
603 F.3d 904 (2010)

- Written by Sarah Holley, JD
Facts
Over the course of several months, Van Buren Lee (defendant) communicated online with a federal postal inspector posing as “Candi Kane,” the “open-minded mother of two beautiful [minor] girls.” Lee and Candi repeatedly discussed whether, how, and when Candi would grant Lee sexual access to her daughters. Lee produced and sent Candi and her daughters sexually explicit photographs of himself. Lee invited Candi to watch a live stream of him masturbating and ended the stream by “sending his love” to the girls. Lee promised to send gifts to Candi’s daughters and, in another conversation, promised he had been shopping for coloring books, dolls, and necklaces. Lee also requested that Candi produce and send to him sexually explicit photographs of her daughters in specific poses, which, so far as Lee knew, she did. The federal postal inspector, in fact, arranged for government agents to deliver Lee a package that purported to contain photographs of Candi and her daughters. Lee was arrested when he retrieved the package of child pornography and was later convicted for attempted enticement of a minor. Lee appealed.
