Facts
Jay Lentz (Lentz) was charged with the murder of his wife, Dorris Lentz (Dorris). At trial, the prosecution (plaintiff) sought to introduce out-of-court statements Dorris made on the day she disappeared. The prosecution argued that the statements were admissible under the forfeiture-by-wrongdoing exception to the hearsay rule under the theory that Lentz procured her unavailability by killing her.
