Facts
John Rife (defendant) was charged with crimes related to a public corruption case involving Rite Way Service, Inc. (Rite Way). Cecil Clark worked for Rite Way and pled guilty to conspiracy to commit bribery. Clark then began working with the prosecution (plaintiff). Clark planned to testify at trial and had handwritten notes that inculpated Rite Way and its employees in the corruption. Rife filed a motion in limine to exclude the notes as hearsay. The prosecution argued that the notes were admissible as a prior consistent statement under Federal Rule of Evidence 801(d)(1)(B).
