Facts
Prior to trial in the United States District Court for the Southern District of Florida, Lowery (defendant) filed a motion to suppress the planned testimony of an alleged coconspirator. The planned witness had entered into a plea agreement with the prosecution (plaintiff) under which the witness’s sentence would be reduced if the witness agreed to testify against Lowery. The district court granted the motion based on the Florida Bar Rules of Professional Conduct, which prohibited giving something of value to a witness. The prosecution appealed.
