United States v. Marzzarella
United States Court of Appeals for the Third Circuit
614 F.3d 85 (2010)
- Written by Angela Patrick, JD
Facts
A federal law made it a crime to own a gun that did not have a serial number. The law existed to allow law enforcement to trace the ownership of guns used in crimes. Michael Marzzarella (defendant) was convicted of violating the federal law by owning a gun with an obliterated serial number. On appeal, Marzzarella argued that his conviction should be vacated because the federal law violated his Second Amendment right to keep and bear arms.
