Facts
Ronald McClure, Jr. (defendant) was indicted for the federal crimes of being a felon in possession of a firearm and ammunition, kidnapping, retaliating against a witness, and sex trafficking of children. The government (plaintiff) moved to preclude McClure from obtaining any ex parte early-return subpoenas pursuant to Federal Rule of Criminal Procedure 17(c). The government argued that Rule 17(c) subpoenas in child sex-trafficking cases typically requested records held by juvenile court and child protective services pertaining to government witnesses and were unwarranted intrusions into the private and confidential files of minors.
