Facts

John McGuire (defendant) was charged with numerous offenses, including robbery of sound equipment from an out-of-state television news crew. His first trial ended in a hung jury. Prior to his retrial, one of the robbery victims had her doctor send the court a note stating that she would be unavailable to testify because she was seven months pregnant and unable to endure the stress of testifying. Over McGuire’s objection, the district court allowed the jury to view a videotape of the witness’s testimony from McGuire’s first trial. McGuire was convicted and appealed.
