Facts
Senh Phun and others (defendants) agreed to steal cocaine from a drug cartel’s stash house. They were arrested before they attempted to go through with the robbery. Unbeknownst to them, the stash house did not actually exist. The stash house had been invented by an undercover officer. Phun and the others were convicted of conspiracy to commit robbery. The defendants appealed, claiming that they could not be convicted for conspiracy to commit a crime that was factually impossible to commit.
