Facts
The United States government (plaintiff) filed an action against the Mongol Nation (defendant) in federal district court, charging the Mongol Nation with violation of the Racketeer Influenced and Corrupt Organizations Act (RICO). The Mongol Nation, which was a group of official members of the Mongols Gang, was identified in the indictment as the “person” involved in the RICO offense. The Mongols Gang was made up of the Mongol Nation as well as various other members who were not part of the Mongol Nation. The Mongol Nation filed a motion to dismiss the indictment. The district court granted the motion, holding that the Mongol Nation was not sufficiently distinct from the Mongols Gang to establish a RICO person separate from the RICO enterprise. The government appealed.
