Facts
Rodney Moore (defendant) and several others (collectively Defendants) were charged in a 158-count federal indictment with committing various criminal acts including 31 murders, conspiracy, and extensive narcotics trafficking in the Washington, D.C. area. At trial, the prosecution’s first witness was FBI Agent Daniel Sparks who provided, over the objections of defense counsel, overview testimony about the case, including his opinions about the charged crimes, the reasons for Defendants’ actions in various circumstances, the nature of the conspiracy, and relationships of co-conspirators—all before any evidence was presented. Defendants were convicted. Defendants appealed.
