Facts
Robert Murray (defendant) was charged with obstruction of justice. The prosecution (plaintiff) presented recordings in which Murray told Michael Sannes not to cooperate with an ongoing investigation. Specifically, Murray told Sannes not to testify and not to admit to having taken part in the conduct giving rise to the investigation. Murray told Sannes that he would hurt Sannes if Sannes did not listen to Murray’s instructions.
