Facts
Jake Keller Neal (defendant) was charged with bank robbery and homicide. Jake’s wife, Marcia Neal, had cooperated with the Federal Bureau of Investigation (FBI). An FBI agent listened to and tape-recorded three telephone conversations between Jake and Marcia. Jake was not aware that the FBI agent was present during the telephone conversations. At the district court, the government (plaintiff) sought to admit the statements made by Jake to Marcia during the telephone conversations. Jake contended that his statements were protected by the marital-communications privilege. The district court took the matter under advisement.
